Amendment of laws and putting forward draft laws and decrees

the most important part of the draft law is the following:

  • The Abolition of 90% of the decisions subject to administrative control, so that to take effect without any ratification.
  • Allowing the private sector to manage or to contribute to managing the projects within the municipalities when the municipal funds are insufficient.
  • Shortening the term of municipal councils from six to five years, and cancelling paragraph (5) of Article (11) of the current law which provided the withdrawal of confidence from the President and Vice President after the expiration of three years following their election.
  • The election of the President and Vice-President through direct public voting to increase their democratic popular representation.
  • The necessity of proper qualifications for presidency, vice-presidency or municipal council candidates to varying degrees and according to the post sought, with a view to raise the professional level of popular representation along with the positive effects that this proposal might generate on the performance of the municipal council.
  • The decisions of the municipal council are no longer subject to ratification by the supervisory authority (the Minister, the Governor, and the Mayor). These decisions are considered effective from the date of publication on site at the municipal center with the exception of decisions which remained subject to ratification by law and to which there is time for ratification. Otherwise, it shall be approved as set out by the municipality, all this in order to give municipalities more autonomy in the management of local affairs with a view to speed up the disposition and implementation to improve the performance of municipal work and promptly securing the interests of citizens.
  • Cancelling the position of Council Guide and replace it with the establishment of a Training Institute in order to train all municipality staff in addition to training police and municipal guards.
  • The features of this bill can be resumed by clarifying problematic issues and bringing a large number of new provisions along with being incorporated in gratifying circumstances.

Traffic Law:

The Ministry of Interior and Municipalities introduced a bill aiming at amending some provisions to the traffic law, which was approved by the Council of Ministers and referred to the House of Representatives for authorization. The main features of the amendment are as the following:

  • To impose strict measures in terms of booking or incarceration of vehicles or the retraction of driving permits or licenses in a large number of irregularities and according to their relevance or risk or recurrence with the implementation of these measures, knowing that this is the responsibility of the record organizers or by the concerned court ruling, which could include imprisonment.
  • To impose new measures up to the extent of imprisonment for violations such as the following:
    • For not wearing helmets by motorcyclists.
    • For perfoming acrobatic games by motorcyclists.
    • For seating children under ten years on the front seats.
    • For excessive speed resulting from drink driving or for reasons of Amble.
    • For not placing children under three years in a child seat.
    • for not-using seat belts by occupants of the front seats.
  • For tightening the fines, taking into account the proportionality among each of these irregularities.

Modifying the Ads decree:

The Ministry of Interior and Municipalities is practically seeking to amend the current ads decree (advertising posters), thus making of it a decree developed along the lines of what is implemented in European countries. The amendment includes fixed and mobile ads, in addition to rearranging their locations, licensing and imposing the conditions on the basis of the rapid developments and expansion which affect this sector. The ministry established for this purpose a commission which included a number of 1st grade staff, mayors, people of skill and expertise in the area of the consultants and owners of advertising companies from the private sector to take their views and find solutions to their problems.

Establishment of health councils in the provinces:

The Ministry proposed a bill to establish a health board in each province, which was submitted to the Council of Ministers who passed it to the House of Representatives in order to facilitate citizens’ matters at all levels.

The ministry issued a circular related to the formation of a committee to amend the law of municipal fees and allowances 12 years after it was initially published without amendments. However, this topic remains under consideration.
